• User Conduct While using CricketMatchUp, you agree not to post, upload, transmit, distribute, store, create, or otherwise publish through the application any of the following: (a) any message, data, information, text, music, sound, photos, graphics, code, or other material ("Content") that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable; (b) Content that would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national, or international law; (c) Content that may infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party; (d) Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity; (e) unsolicited promotions, political campaigning, advertising, or solicitations; (f) private information of any third party, including, without limitation, addresses, phone numbers, email addresses, social security numbers, and credit card numbers; (g) viruses, corrupted data, or other harmful, disruptive, or destructive files; and (h) Content that, in the sole judgment of CricketMatchUp, is objectionable or which restricts or inhibits any other person from using or enjoying the application, or which may expose CricketMatchUp or its users to any harm or liability of any type.
• Termination CricketMatchUp reserves the right, in its sole discretion, to terminate your access to all or part of the application, with or without notice. CricketMatchUp also reserves the right to suspend or terminate any user's access to the application for any reason, including, but not limited to, violation of this Disclaimer or any other agreement applicable to the user's use of the application.
• Indemnification You agree to indemnify, defend, and hold harmless CricketMatchUp, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this Disclaimer or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the application using your internet connection.
• Dispute Resolution Any controversy or claim arising out of or relating to this Disclaimer, or the breach thereof, shall be settled by arbitration administered by the applicable arbitration body in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
• Severability If any provision of this Disclaimer is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible and will be deemed deleted from this Disclaimer, and the remaining provisions of this Disclaimer shall remain in full force and effect.
• Waiver The failure of CricketMatchUp to exercise or enforce any right or provision of this Disclaimer shall not constitute a waiver of such right or provision. Any waiver of any provision of this Disclaimer will be effective only if in writing and signed by CricketMatchUp.
• No Endorsement CricketMatchUp does not endorse any content or any opinion, recommendation, or advice expressed on the application, and we expressly disclaim any and all liability in connection with such content. CricketMatchUp does not permit copyright infringing activities and infringement of intellectual property rights on its application, and CricketMatchUp will remove all content if properly notified that such content infringes on another's intellectual property rights.
